ABSTRACT: False allegations and defamatory claims represent severe infringements on individual dignity, causing lasting social stigma and severe psychological trauma. This research paper critically evaluates the existing legal framework in India governing civil and criminal defamation alongside remedies against malicious prosecution. By analyzing statutory provisions under the Indian Penal Code, Bharatiya Nyaya Sanhita, and landmark judicial precedents, the study assesses how unverified accusations erode personal reputation and mental wellbeing. Special attention is given to the gender-specific dynamics of statutory protections and the lack of immediate compensatory mechanisms for victims of false charges. The paper underscores the urgent need for procedural safeguards against the misuse of law to prevent character assassination. Furthermore, it highlights the role of judicial efficiency in restoring damaged reputations within a rapidly evolving digital landscape. Ultimately, the study advocates for comprehensive legislative reforms balancing freedom of speech with the constitutional right to reputation under Article 21.
